 Limited Warranty.

THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. EXCEPT AS SET FORTH HEREIN, AEGIS MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THE SERVICES (INCLUDING ANY SYSTEM, MAINTENANCE SERVICES, MONITORING SERVICES, OR OTHER SERVICES AND EQUIPMENT) AND DISCLAIMS ANY AND ALL WARRANTIES OF MERCHANT- ABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, OR ANY OTHER WARRANTY.

Customer acknowledges that no other representations were made to Customer or any other person or entity or relied upon by Customer or any other person or entity with respect to the quality and function of the Services. Customer acknowledges that any affirmation of fact or promise made by Aegis shall not be deemed to create an express warranty; and that Aegis does not make any representation or warranty, including any implied warranty of merchantability or fitness, or that the Services or other products or services supplied may not be compromised, circumvented, or will in all cases provide the warning, fire protection, security, surveillance, signaling, monitoring, level of repair, responsiveness, fitness, response, alarm, or other purpose for which it was intended. Customer is not relying on Aegis’s skill or judgment in selecting, furnishing, or configuring Services suitable for any particular purpose. Unless otherwise explicitly set forth in the Agreement, notwithstanding any other provision of the Agreement, during the first 90 days after installation of a System, Aegis will repair or, at its option, replace any defective part of the System, including wiring, or repair any defective workmanship, at no charge to Customer, including labor. Aegis will use new or functionally operative parts for replacements as Aegis determines in its sole discretion.

This LIMITED WARRANTY is for Customer’s benefit only and may not be enforced by any other person or entity. Customer’s exclusive and sole remedy with respect to this limited warranty shall be the repair or replacement by Aegis of any defective part of the System or the repair of any defect(s) in workmanship that arise during said 90 day period only; and in no event shall Aegis, its officers, agents, employees, or subcontractors be liable to Customer or any other person or entity for any direct, indirect, special, consequential, incidental, or other damages (including, without limitation, any lost profits or business interruption) for any reason, regardless of whether the claim is based on breach of warranty, contract, tort, or otherwise.

AEGIS SHALL HAVE NO OBLIGATIONS UNDER THIS LIMITED WARRANTY OR OTHERWISE IF AEGIS DETERMINES, UPON INSPECTION, THAT ANY OF THE FOREGOING CAUSED OR CONTRIBUTED IN ANY WAY, DIRECTLY OR INDIRECTLY, TO THE NEED FOR REPAIR OR REPLACMENT:
     a. Act of God;
     b. Alteration or misuse by Customer or other persons or entities not a party to this Agreement;
     c. Power spikes or other irregularities (including power interruption) with respect to the System’s or the System’s power source(s);
     d. Customer’s failure to follow operating instructions; or e. Alterations to the Site after installation not approved by Aegis in writing.
